Terms of Service

1. Acceptance of Terms

By accessing or using fileshare.ing (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, anonymous users, and registered account holders.

"fileshare.ing," "we," "us," and "our" refer to the operators of this Service. "You" refers to any person or entity using the Service.

2. Service Description

fileshare.ing lets you upload files and share them via short links (fileshare.ing/f/{short_id}). You can also host static websites from uploaded archives. No account is required to start.

The Service operates at three levels, each with different limits:

  • Anonymous — No account needed. Files up to 100 MB. Links expire in 24 hours. 3 uploads per day, 500 MB total across active uploads.
  • Free account — Files up to 2 GB. Links last up to 7 days. 5 GB total storage. 3 projects. Download pages include a 5-second countdown and one banner ad.
  • Starter ($5/mo) — Files up to 10 GB. Links last up to 90 days. 50 GB total storage. No ads on download pages. API access at 100 requests/day.
  • Pro ($12/mo) — Files up to 50 GB. 200 GB total storage. Permanent links. Full analytics, 10,000 API requests/day, custom branding.

Static site hosting is available on all paid plans. Feature availability varies by plan and may be updated from time to time.

3. Account Registration & Organizations

When you register, you provide an email address and password. You are responsible for keeping your credentials secure and for all activity under your account.

Each account belongs to an Organization. The Organization is the billing unit — all storage, upload, and bandwidth limits are enforced at the Organization level. Initially, every registered user has one Organization. Pro plan users may add up to 5 team members to their Organization; all members share the Organization's limits.

You must provide accurate registration information. Accounts created by bots or through automated means without our consent are prohibited.

4. User Content — Your Responsibility

You are solely responsible for every file you upload. fileshare.ing is a neutral hosting and distribution platform. We do not review, curate, endorse, or verify uploaded content before it is published. The presence of a file on our platform does not imply our approval or endorsement.

By uploading content you represent and warrant that:

  • You own the content or have all rights, licences, and permissions necessary to upload and distribute it.
  • The content does not violate any applicable law or regulation in any jurisdiction from which it may be accessed.
  • The content does not infringe the intellectual property, privacy, or other rights of any third party.
  • You are not uploading content on behalf of someone who lacks the legal right to do so.

fileshare.ing accepts no liability whatsoever for the content users upload. Any legal claims, damages, or losses arising from uploaded content are the sole responsibility of the uploader.

5. Prohibited Content & Activities

The following are strictly prohibited. Violation will result in immediate content removal, account termination, and where required by law, reporting to authorities.

  • Malware and malicious software — viruses, ransomware, spyware, trojans, stealers, keyloggers, or any code designed to damage, exploit, or gain unauthorised access to systems or data.
  • Child sexual abuse material (CSAM) and child exploitation content — absolute zero tolerance. Any such content is immediately removed, the account permanently terminated, and the incident mandatorily reported to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement agencies.
  • Copyright-infringing content — uploading, distributing, or hosting content you do not own or have no licence to distribute. We comply with the Digital Millennium Copyright Act (DMCA) and will act promptly on valid takedown notices.
  • Phishing, fraud, and social engineering — using fileshare.ing links or hosted pages to impersonate organisations, steal credentials, deceive users, or facilitate financial fraud of any kind.
  • Spam and unsolicited distribution — bulk distribution of fileshare.ing links via unsolicited email, SMS, or messaging platforms.
  • Illegal content of any kind — content that is illegal in the jurisdiction where it is uploaded or where it is accessed, including but not limited to: content that incites violence or terrorism, human trafficking materials, non-consensual intimate imagery (NCII / "revenge porn"), content that violates sanctions or export control laws, and material facilitating drug trafficking or other criminal enterprise.
  • Harassment and hate content — material that targets individuals or groups with threats, harassment, or hate speech based on protected characteristics.
  • Executable files on Anonymous and Free plans — .exe, .bat, .msi, .sh, .cmd, and .ps1 files are blocked on anonymous and free-tier uploads to reduce malware distribution risk.
  • Service abuse and circumvention — bypassing storage or rate limits, reverse-engineering the Service, automated scraping, using the Service to attack or probe other systems, or creating multiple accounts to avoid enforcement actions.

We reserve the right to remove any content, with or without notice, that we determine in our sole discretion to be in violation of these terms or otherwise harmful. Removal of content does not entitle you to any refund.

6. Content Ownership & Licence

You retain full ownership of the files you upload. We do not claim any intellectual property rights over your content.

By uploading a file, you grant fileshare.ing a limited, non-exclusive, royalty-free licence to store, copy, process, and serve that file solely for the purpose of operating the Service — including delivering downloads to people you share your link with. This licence ends when the file is deleted or expires.

You represent that you have the right to grant this licence for every file you upload. Uploading content you have no right to distribute is a breach of these terms and may expose you to civil and criminal liability.

6a. Indemnification

You agree to indemnify, defend, and hold harmless fileshare.ing and its operators, officers, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • content you upload, share, or host through the Service;
  • your breach of these Terms;
  • your violation of any applicable law or the rights of any third party; or
  • any dispute between you and another user or third party.

This indemnification obligation survives termination of your account.

7. File Expiry & Deletion

Files are deleted automatically based on the plan at time of upload:

  • Anonymous upload: 24 hours after upload
  • Free account: 7 days after upload (or last-accessed, where configured)
  • Starter account: 90 days after upload
  • Pro account: Permanent — files persist until you delete them or close your account

Once a file is deleted or expires, it is permanently removed from our storage. We do not keep backups of user content. We are not responsible for any loss of data due to file expiry. If you need a file to persist, upgrade your plan or save a copy yourself before the expiry date.

8. Storage & Usage Limits

All limits — storage, daily uploads, file size, and bandwidth — are enforced at the Organization level. Uploads will be rejected if your Organization exceeds its limit.

We may enforce limits automatically and without prior warning. If you believe a limit is applied in error, contact support@fileshare.ing. We may delete files to bring an Organization back within its allowed quota, starting with the oldest files.

9. Abuse Reporting & DMCA

Every download page includes an abuse report button. After 3 independent reports for the same file, that file is automatically disabled pending review. We review all reports and restore files that were reported in error.

If you believe content on fileshare.ing infringes your copyright, send a DMCA takedown notice to legal@fileshare.ing with:

  • Identification of the copyrighted work claimed to be infringed.
  • The URL of the allegedly infringing material on fileshare.ing.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • Your contact information (name, address, phone, email) and a physical or electronic signature.

If you believe your content was removed by mistake, you may submit a counter-notification to the same address. We will reinstate the content within 10 business days unless the complainant files a court action.

10. Subscriptions & Billing

Paid plans are billed monthly or annually through Stripe. Subscriptions auto-renew at the end of each billing cycle. You can cancel at any time from your account settings — cancellation takes effect at the end of the current billing period.

We offer a 7-day money-back guarantee on first-time paid subscriptions. Contact support@fileshare.ing within 7 days of your first charge. Refunds are not available for renewals or after 7 days.

If you cancel or downgrade, your account reverts to the lower plan's limits at the end of the billing period. Files that exceed the lower plan's retention policy will be deleted at the transition date. You will receive an email warning before any files are deleted.

We reserve the right to change pricing with 30 days' notice. Price changes do not apply to the current billing cycle.

11. Advertising

Download pages for anonymous uploads and free-account files include a single banner advertisement served by Adsterra, plus a 5-second countdown before the download button appears. There are no pop-unders, autoplay audio ads, or interstitials.

Ads are not shown on download pages for files uploaded by Starter or Pro accounts. Ads are never shown on any content-management or dashboard pages.

Adsterra, as a third-party ad network, may set cookies on download page visitors. See the Privacy Policy for details.

12. Termination

We may suspend or terminate your account immediately for any violation of these terms, particularly for prohibited content, abuse of the Service, or fraudulent activity. In serious cases (e.g., CSAM), there is no warning period.

You may close your account at any time from your account settings or by emailing support@fileshare.ing. On account deletion, all your files and data are permanently removed from our systems within 30 days. Download links for your files will return a 404 immediately upon deletion.

Sections 6 (Content Ownership & Licence), 6a (Indemnification), 9 (DMCA), 13 (No Liability for User Content), 14 (Disclaimer), 15 (Limitation of Liability), and 17 (Governing Law) survive termination.

13. No Liability for User Content

fileshare.ing is a neutral hosting provider. We are not the publisher or speaker of user-submitted content and are not liable for that content under any theory, including Section 230 of the Communications Decency Act (US) and equivalent safe-harbour provisions in other jurisdictions.

We do not monitor uploads for legality, accuracy, or appropriateness prior to publication. Reporting mechanisms exist for abuse, but their availability does not make us liable for content we have not reviewed. If you believe content on the Service violates your rights, use the abuse report button or contact us at legal@fileshare.ing.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that files will be preserved without loss.

We make no warranty regarding the conduct of other users or the content they upload. You access user-uploaded content entirely at your own risk.

15. Limitation of Liability

To the fullest extent permitted by law, fileshare.ing and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, lost profits, service interruption, or harm arising from user-uploaded content, whether or not we were advised of the possibility of such damages.

Our total liability for any claim arising from these terms or your use of the Service will not exceed the amount you paid us in the 12 months before the claim arose. For anonymous or free users, our total liability is $0.

Some jurisdictions do not allow certain liability exclusions. To the extent such exclusions are unenforceable, our liability is limited to the minimum extent permitted by applicable law.

16. Changes to Terms

We may update these Terms at any time. We will post the revised terms on this page with an updated effective date. For material changes, we will notify registered users by email at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.

17. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes arising under these terms will be resolved in the courts of Delaware, and you consent to personal jurisdiction there.
